Wow.
Virginia's DUI law is unconstitutional (according to one judge) because it presumes that BAC >.08 = intoxication. This might not go anywhere, but it's interesting reasoning. Well worth reading for the idiotic quote from the state Delegate (like our state Representatives only more colonial) - let his reasoning really sink in.

This is a very clear and articulate argument
in favor of the opposition party choosing its battles carefully. This has always seemed like a no-brainer to me, but many folks seem to want to throw all of our resources at whatever outrage has occurred most recently. Put differently: There are people who would rather lose over Roberts than win over Rove (or Bolton). Cook, in my view a brilliant, fair-minded political analyst and worth reading every week, puts the rationale for making tough strategic choices in plain English.
It occurs to me that folks like ACT and MoveOn, bless their blue* hearts, need to get people riled up over each and every Republican transgression against decency and good government just to keep the money flowing in. Another example of how that which is good for particular organizations is not always good for the people they claim to represent.
* I think we're due for the next red-blue switch-up in '08 - I wonder if all those books and articles will seem confusing in hindsight, or if the networks will defer to the recent entrenchment of arbitrary colors? Open letter from Steven "Everything Bad Is Good For You" Johnson to Sen. Hillary Clinton. If you've already dismissed Mr. Johnson w/o reading beyond his thesis du jour, reconsider. He's got the facts on his side, and his arguments are more sophisticated than you might think. Plus, he's a wicked good writer.
